A resident asked about a comment someone made at the February 18th meeting regarding students parking on Mitchell Avenue and if that area could be included in the parking ordinance prohibiting non-resident parking during school hours. Another resident of Mitchell Avenue said that he has three students parking in front of his house on most school days. Scott Sylvainus said that area had not been studied when the parking ordinance was drafted.
A Georgetown Road resident asked about getting a waterline extended in his area.
SUPERVISORS
The Supervisors held a discussion about Data Centers. Currently, this is not an identified use under UNT’s zoning plan. Upper Nazareth has coordinated zoning with Lower Nazareth (LNT) and Chapman Borough. There isn’t enough space for a data center in Chapman which means either UNT or LNT would have to accommodate it should one be proposed. Scott Sylvainus pointed out that no one wants a data center but regulations need to be put in place to limit impacts from such a facility. Scott said that there are 5 different sizes for defined data centers, ranging from the size of a closet up to 1 million ft2. One possibility is for UNT and LNT to split the zoning with one municipality allowing for the smaller data centers and the other allowing for the biggest one.
William Bartlett pointed out that, with the hyperscale version, there could be major impacts from water, power, noise, etc and that we can’t make them impossible via zoning. Scott Sylvainus said that this area would be more likely to get the smaller data centers and that regulations could be put in place for setbacks, noise reduction and berms. South Whitehall has nine impact items developers must address before filing an application. Lisa Klem said that UNT needs to get regulations in place before an ordinance can be written.
Township Solicitor Gary Asteak recommended that both UNT and LNT adopt very strict regulations. William Bartlett proposed writing as strict an ordinance that would be legally permitted. Scott Sylvainus said that the Planning Commission has been talking about this for a couple of months. One issue is generating energy on site. A building on Newlins Road is using Hydrogen for energy generation which could be an extreme safety risk. Palmer had to allow it because they didn’t have any ordinances in place. Land in UNT which could be used for a data center includes the field west of the Intermediate School, some parcels along East Lawn Road and land in the western part of the township.
The Township Engineer shared an ordinance from York County which regulated a number of issues including environmental impacts, vibrations, noise, construction traffic, generating energy on-site, requiring solar panels, water and what will happen to the data center should the owner walk away from it.
Gary Asteak said he will draft an ordinance consistent with York’s version and will suggest that LNT do the same.
William Bartlett asked if it could include risks from sinkholes and the Engineer said that was covered under SALDO.
TOWNSHIP ENGINEER
Construction on the Penn Dixie bridge will begin in April.
TOWNSHIP SOLICITOR
The Nazareth Area School District requested an exoneration from their real estate tax bill, beginning in 2027 for the property at 350/370 East Lawn Road–Cost of $1,231.65. (NASD has claimed eminent domain on that property and is working out payment with the Calandras.) The Supervisors tabled the motion.
Approval to write a letter to Palmer Township agreeing with the Chrin Corporation’s request to change the zoning on the land next to the field east of the Intermediate School to TD-10. Motion passed 3-to-2. (Bartlett and Sayago voted against.)
TOWNSHIP MANAGER
Lisa Klem announced that, until they can work out the technical difficulties, meetings will be in-person only and no longer available on-line.
PLANNING & ZONING
Approval of an Extension Request for The Estates at Silvercrest until December 31, 2026.
PUBLIC WORKS
Approval to accept the resignation of a part-time PW employee.
Approval for a quote from Wind Gap Electric to upgrade the basement for $3,855.
Shawn Shupe thanked the Fire Department for their help during the recent snowstorms.
POLICE DEPARTMENT
Approval to pay for the Chief to attend The School of Police Staff and Command for $5,000.
