The Upper Nazareth Township Zoning Hearing Board will hold a public hearing on Wednesday, June 24, 2020 at 6:30PM at the Upper Nazareth Township Municipal Building, 100 Newport Avenue, Nazareth, PA 18064.
The Zoning Hearing Board will meet to hear the following Zoning Appeal: Case # ZB 20-045 Interpretation of Zoning Ordinance.
Appellants-applicants ( the “Citizen Group”) are Jason and Shannon Mohap, Bernard and Elizabeth Kotyuk, Kathleen and Bradley Leach, Wendy Colussi, Paul and Jennifer Heric, Craig and Darlene Hanchett.
Location of Property subject to appeal: 3363 Gun Club Road, Nazareth, (Upper Nazareth Township) PA, 18064. Parcel # K6-21-1-0432 & K7-14-1-0432 (“the Property)
Nature of Appeal: The Citizen Group seeks to secure a decision by the Upper Nazareth Township Zoning Hearing Board as to whether the Township Zoning Officer erred in a written opinion as to the use classification of the Tadmor facility being proposed for the Property by developer JVI,LCC in accordance with the Township’s Ordinances, erred in not seeking outside expert opinion as to the meaning of a “high cube warehouse”, erred in not finding that the proposed facility is a principal-use distribution center and truck terminal, erred by failing to secure a legal opinion from the Township Solicitor, erred by ignoring the actual proposed use and erred by not obtaining a definitive decision from the Zoning Hearing Board.
The Zoning Hearing Board will also consider a challenge the timeliness of the appeal.
