Faust Family Limited Partnership #2 has filed a lawsuit against 318 homeowners in Farmview Estates and Upper Nazareth Township without the courtesy of informing them that they’d been sued. Someone discovered the existence of their lawsuit when they applied for a loan and were told there was a lien on their house.
Case C-48-CV-2021-07058 was filed on August 31, 2021 by Alfred S. Pierce from Pierce & Steirer, LLC.
Faust Family Limited Partnership owns a tract of land along West Street, between 2nd and 4th Street, Parcel J8SW4-11-4. The suit states “…all claims of Defendents to a right or use of the paper streets or rights-of-way, in particular all of West Street and one-half of 2nd Street and Wood Street, in the Plan of record are forfeited and surrendered.” Homeowners in the area are being sued to abandon, relinquish and surrender any claim of title or interest in the property.
Instead of serving the homeowners with papers to inform them that they had been sued, the Plaintiff ran an ad somewhere. The order to do this was signed by a judge on September 17th but I am not aware of when or if the ad has actually been published. For anyone who wants to defend against the claims, they have 20 days to take action by entering a written appearance personally or by attorney and filing in writing with the court their defenses or objections to the claims set forth in the suit.
Faust Family Limited Partnership 2 isn’t just the Plaintiff, they’ve also listed themselves as a defendant. I’m not a lawyer but that seems weird.
This isn’t the first time Faust has sued the homeowners of Farmview Estate. A similar suit was filed in December 2018 but had to be pulled when it was revealed that the ad had never been published.
