I spoke about a public notice recently put out by Hercules Cement (Buzzi Unicem), requesting exceptions to Section 184 of the Clean Air Act for their Stockertown plan in regards to nitrogen oxides and/or volatile organic compounds. I requested Upper Nazareth Township send a letter to the state’s Air Quality Program objecting granting this exception.

The EPA identifies nitrogen oxides (No x) as a cause of respiratory irritation, worsened asthma and decreased lung function. Volatile organic compounds (VOC) cause eye, nose and throat irritation, headaches, nausea, loss of coordination and damage to the liver. Some VOCs are also classified as suspected carcinogens. The Lehigh Valley is ranked as having one of the highest concentrations of asthma cases in the United States. We are 6th in the nation for asthma-related ER visits. The Asthma & Allergy Foundation of America’s “2025 Asthma Capitals Report” ranks Allentown as the 3rd worst location for people with asthma in the country. The American Lung Association’s “State of the Air” 2025 report ranks this area as 50th for particle pollution with Northampton County as the worst county in the region for ground level ozone and short-term particle pollution.

TOWNSHIP ENGINEER

Construction on the Penn Dixie is completed and it will open on August 6^th. One guard rail needs to be painted.

The PA American Water project on Sycamore Street has been completed.

During the paving project, traffic on Gun Club Road will be detoured. The project is expected to take 2-3 weeks.

TOWNSHIP SOLICITOR

A Public Hearing was held for a dispute between One More Properties and the Nazareth Area School District concerning 9 acres at 350 and 370 Gun Club Road. This land previously belonged to the Calandras but NASD filed a “Declaration of Taking” and assumed control of the property in February 2026 with compensation of $1.8 million paid. One More Properties had filed plans for apartments on that parcel: Aspire 1 was submitted to the township on May 21, 2025 and Aspire 2 was submitted on June 17, 2025.

One More Properties was requesting that their plans be put in abeyance (a temporary suspension.) Julie Burkheart, speaking for the NASD, claimed that One More Properties no longer had ‘standing’ which would be required for having any say about what happens to the property. One More Properties attorney, Mark Eastburn, argued about the definition of ‘landowner,’ claiming that a landowner could be anyone who has proprietary interest in the land under the Municipal Planning Code.

The Supervisors adopted Resolution No. 26-09 to deny approval of Aspire Land Development #1 and Resolution No. 26-10 to deny approval of Aspire Land Development #2.

The School District Solicitors then weighed in on the approval to advertise a Zoning Ordinance amendment which would affect the number of parking spaces for the plan they want to file. Angela Stohl, the Zoning Officer, pointed out that the amendment applies to the entire township, not just the property the School District wants to develop. Angela said that the plan the School District submitted will be governed under the old ordinance. Lisa Klem pointed out that the Planning Commission has reviewed the Zoning Ordinance amendment twice.

TOWNSHIP MANAGER

Approval to apply for a Local Share Grant for a 2027 Police Interceptor Utility AWD Base Responder. (No. 26-11)

Approval to apply for a Local Share Account Grand for a Conference Room Audio-Visual System. (No. 26-12)

Approval to adopt Resolution No. 26-13 about the Disposition of Records: Meeting Sign-in Sheets.

Approval for employees to attend the PSATS Public Works Expo in November at a cost of $2,700.

RECREATION

Tabled – a proposal for Destination Unknown to provide tethered balloon rides at the Car Show on August 22^nd.

EAC

Approval for Edge of the Woods for a one-time application of an herbicide and a one-time mowing of the trail at Harvest Grove.

POLICE DEPARTMENT

Approval to sell a 2019 Dodge Durango for $9,100.

Approval for Pye-Barker to install key-fob access to the front door of the Police Station at a cost of $2,645.
